These Terms and Conditions form an Agreement (the Agreement) between you and the New Zealand Land Rover Forums (NZLRF) community, which includes the administrative personnel of this website (the “Admins”), and governs use of this website and/or the NZLRF Mobile App. “Content” refers to any posts, comments, media and/or documentation created by you or other NZLRF members. “Advertising” includes posting your business name, product/service names, or any logos on any photos that may be posted.
By using the NZLRF website and/or installing the NZLRF Mobile App, you agree to be bound by this Agreement, and understand that:
- All Intellectual Property Rights in any content on the NZLRF website and/or contained within the NZLRF Mobile App, is owned by the Admins, except that which is uploaded by you or other NZLRF members on this or other NZLRF sites, including Social Media sites.
- You retain your existing rights to any Content posted by you on this website and/or app, and other NZLRF sites, including on social media sites. You remain the sole legal publisher of all such Content. Removal of your Content may be requested by you at any time.
- In posting Content on the NZLRF website and/or the NZLRF Mobile App, you agree to grant NZLRF a perpetual, non-exclusive, worldwide, and royalty-free licence to use the Content, for any purpose, whether on an NZLRF site or elsewhere, to the extent permitted by law.
- This Agreement takes precedence over any Terms and Conditions, including but not limited to copyright restrictions, you may impose on your own Content. In posting the Content on NZLRF sites, you hereby agree that any such Terms and Conditions imposed by you are nullified and replaced by this Agreement.
- NZLRF, the Admins, and NZLRF Sponsors and/or Suppliers, cannot be held responsible or liable for the publication of any Content posted by you that is restricted by other parties, including but not limited to copyright restrictions. It is your sole responsibility to ensure you have rights to post the Content. You agree to be solely liable for the publication of such Content and on-publication of such Content on other sites, by you or other parties including the Admins.
- Content on the NZLRF website and/or the NZLRF Mobile App, whether posted by the Admins or other NZLRF members, cannot be used as evidence to bring any actions against NZLRF, the Admins, or NZLRF Sponsors and/or Suppliers, at any time now or in the future, to the extent permitted by law.
- Posting objectionable Content, that is Content objected to by the Admins, may result in disciplinary action at the discretion of the Admins. This may include your permanent removal from the NZLRF community, and/or legal action against you.
- All member details remain the property of individual NZLRF site members. Members are not entitled to use other member details from the site to send unsolicited advertising or promotional material to NZLRF site members. This is considered a breach of our Privacy Policy. This includes soliciting by sending public or private messages to individual members from the site.
- NZLRF runs a “no-advertising” policy. Members are not allowed to advertise their businesses, products or services, or present NZLRF sponsors negatively, on NZLRF sites. Such posts/comments will result in a reminder of this policy to the member and a removal of the post/comment; further failure to comply will result in the members’ removal from the NZLRF website and associated Social Media sites/groups e.g. Facebook. This includes advertising in photos/images (an exception is made for signwriting on buildings and vehicles in photos).
- Businesses are welcome to promote on NZLRF sites under the following circumstances:
- In reply to a site member who posts or comments a request for a product or service that the business is able to provide, unless the comment is in direct competition with an NZLRF sponsor, or is an overseas business competing with a local New Zealand one.
- Where the business’ services are specifically requested by a site member not affiliated with the business – this may be done publically on the site if the original request is public on the site;
- Where a site member not affiliated with the business promotes the business for the benefit of the community (Note: This may be removed by NZLRF Admins if it is in direct competition with an NZLRF sponsor);
- As a general rule, we may allow the mention of a business only where the original poster or commenter who requested their services is not affiliated with that business, or where the mention does not promote them. Such comments may be removed if they are in direct competition with an NZLRF sponsor or local NZ business, but will generally be allowed unless that sponsor or local NZ business specifically requests their removal.
To the extent permitted by law, NZLRF Admins, and NZLRF sponsors and/or suppliers, disclaim all conditions, representation and warranties in relation to the Content of this website and/or app, and can not be held liable for any loss arising from this Content.
This Agreement is governed by New Zealand law.
If you do not agree with these Terms and Conditions, you are not entitled to use the NZLRF website or the NZLRF Mobile App.
